When overtime applies in the US
Under the federal Fair Labor Standards Act, non-exempt employees earn at least 1.5 times their regular rate for hours worked over 40 in a workweek. The law counts each week on its own: 30 hours one week and 50 the next means 10 overtime hours, not zero.
Some states go further. California, for example, also pays 1.5× after 8 hours in a day and 2× after 12. Your contract or union agreement can set better terms than the law, never worse.
Salaried workers
Being paid a salary does not by itself remove overtime rights. Whether you are exempt depends on your duties and on earning above a salary threshold. If you are salaried but non-exempt, divide your weekly salary by the hours it is meant to cover to get the regular rate to enter here.
Questions people ask
How do I calculate time and a half?
Multiply your hourly rate by 1.5. At $20 an hour, time and a half is $30 an hour, so 8 overtime hours pay $240.
Is overtime taxed more than regular pay?
No. Overtime is taxed at the same rates as the rest of your wages. A bigger paycheck can have more withheld because withholding tables assume you earn that much every period, but the difference evens out when you file.
Does paid time off count toward the 40 hours?
Under federal law only hours actually worked count. If you took a paid holiday on Monday and worked 36 hours the rest of the week, you have no overtime unless your employer’s policy says otherwise.
